Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Master Annotator (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Service. We may update these Terms at any time by posting the revised version. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

Master Annotator provides a web-based platform for annotating, visualizing, and exporting robotic trajectory data. The Service includes data upload, 3D visualization, frame-by-frame labeling, dataset export tools, and related functionality. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts at our discretion, including but not limited to cases of suspected unauthorized access or breach of these Terms.

4. Subscription Plans and Billing

The Service offers Free, Standard, Pro, and Enterprise subscription tiers, each with different feature limits and storage allocations. Paid subscriptions are billed on a recurring monthly basis through our payment processor, Polar. By subscribing to a paid plan, you authorize recurring charges to your payment method until you cancel.

You may upgrade, downgrade, or cancel your subscription at any time through your account settings. Downgrades take effect at the end of the current billing period, after which a 14-day grace period applies. During the grace period, resources exceeding your new plan's limits remain accessible but read-only. After the grace period, excess resources may be locked or removed.

All fees are non-refundable except where required by applicable law. We reserve the right to change pricing at any time. Price changes for existing subscribers will take effect at the start of the next billing cycle following notice.

5. License to User Data

You retain ownership of data you upload to the Service (“User Data”). By uploading User Data, you grant us a non-exclusive, worldwide, royalty-free license to access, use, process, copy, store, and display your User Data solely as necessary to provide, operate, maintain, and improve the Service. This license persists for the duration of your account and for a reasonable period thereafter to facilitate data export or account closure.

6. Data Removal and Account Termination

We reserve the right to delete, remove, or restrict access to User Data and/or terminate user accounts at our sole discretion, for any reason, including but not limited to:

  • Violation of these Terms or applicable law
  • Extended account inactivity
  • Suspicious, fraudulent, or abusive activity
  • Non-payment or failed payment for paid subscriptions
  • Infrastructure cost management or resource optimization
  • Storage of prohibited, harmful, or illegal content
  • Actions that threaten the security, integrity, or availability of the Service
  • Requests from law enforcement or regulatory authorities

Where practicable, we will attempt to provide reasonable notice before removing data or terminating accounts. However, we are under no obligation to do so, and we shall not be liable for any loss resulting from such removal or termination.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not: upload malicious content or malware; attempt to gain unauthorized access to the Service or its infrastructure; interfere with other users' use of the platform; reverse-engineer or attempt to extract source code; resell or redistribute the Service without authorization; or use the Service to store content unrelated to its intended purpose.

8. No Warranty and Data Loss Disclaimer

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not guarantee that User Data will be preserved, and we expressly disclaim any liability for accidental or unintentional loss, corruption, or deletion of data, whether caused by system failures, software bugs, infrastructure issues, security incidents, or any other reason. You are solely responsible for maintaining independent backups of your User Data.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Master Annotator, its operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of revenue, loss of profits, loss of business, unauthorized access to or disclosure of personal information, data breaches, service interruptions, or damages arising from the use or inability to use the Service — regardless of the cause of action or theory of liability.

Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the claim, or twenty-five US dollars (US$25), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Master Annotator and its operators from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your User Data, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved in a court of competent jurisdiction.
